Terms of Service

These terms govern your use of ItemDraft (itemdraft.com), operated by Özgür IŞIKOĞLU, an individual in Türkiye, not a company (the "Service"). By creating an account or using the Service you agree to them and to our Privacy Policy. If you do not agree, do not use the Service.

The Service analyses product photos with an AI system and suggests listing content such as a title, a price range, a description and keywords for a product, whether it is new or used. The Service is currently in beta: features, limits and availability may change, and we may suspend it at any time.

During the beta the Service is intended for sellers in the United States only. It is not offered to, and you should not use it from, the European Economic Area or the United Kingdom. [Lawyer to confirm this wording and whether anything more is needed to avoid targeting the EU/UK.]

• Output may be inaccurate, incomplete or out of date, including condition, materials, brand, period and price.
• Price ranges are rough estimates. They are not market data, valuations or financial advice.
• Nothing the Service produces is legal, safety or compliance advice. Whether a product may be sold, and which warnings, labels or documents are required in your target market, is your responsibility.
• You must check every result against the actual item before publishing it, and you remain solely responsible for your listings and for complying with the rules of each marketplace.

• The Service only produces text and suggestions. It does not publish anything for you, contact marketplaces on your behalf or check whether an item may lawfully be sold. Any export, copy or use of the output, and any resulting listing or sale, is your own act.
• You are responsible for the accuracy of what you publish and for compliance with consumer-protection, product-safety, labelling, intellectual-property, import and tax rules and the policies of each marketplace in every country where you sell.
• You are the seller of record. We are not a party to your sales, and we do not verify items, authenticity, condition or ownership.
• You will, to the extent the law allows, compensate us for claims by third parties arising from your content, your listings or your breach of these terms. [Lawyer to confirm; this clause may not apply to consumers in some jurisdictions.]

Provide accurate information, keep your password confidential and tell us if you suspect unauthorised use. You are responsible for activity under your account. You must be at least 18 years old, or the age of majority where you live, whichever is higher.

• You keep ownership of the photos you upload. You must have the right to upload them.
• You give us a limited licence to store, process and transmit them to our AI provider solely to operate the Service for you.
• Do not upload photos showing people's faces, personal documents, addresses or licence plates, or content that is unlawful or infringes anyone's rights.
• As between you and us, you may use the generated text for your own listings. Because AI output can resemble existing text, you are responsible for checking it does not infringe third-party rights.

You agree not to:

• use the Service to list counterfeit, stolen, illegal, recalled or otherwise prohibited items, or to misdescribe an item or hide defects;
• claim a brand, authenticity or origin that you have not verified;
• bypass usage limits, create accounts in bulk, scrape or automate the Service without permission, or probe its security;
• interfere with the Service or other users, or use it in breach of any law or marketplace rule.

We may limit, suspend or remove accounts and content that breach these terms.

The Service applies daily and hourly limits that may differ between visitors, registered users and paid plans, and that we may change. During the beta, all features are available to registered users free of charge. Some features may later be limited to paid plans, and we may change or end the free beta access at any time. Paid plans, if offered, will be described with their price and terms before you buy.

The Service is independent of and not endorsed by any marketplace or platform. Third-party services (including our AI and infrastructure providers) are governed by their own terms.

The Service is provided "as is" and "as available", without warranties of any kind to the extent the law allows, including fitness for a particular purpose, accuracy and uninterrupted operation.

To the extent the law allows, we are not liable for indirect or consequential loss, lost profit, lost sales, marketplace penalties or account suspensions, or for loss caused by reliance on AI output. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and 0 USD while the Service is free. Nothing in these terms excludes liability that cannot be excluded by law, and mandatory consumer rights in your country of residence are not affected.

You can stop using the Service and delete your content at any time. We may suspend or end your access if you breach these terms or if we discontinue the Service.

We may update these terms. Continued use after a change takes effect means you accept it. For material changes we will give notice.

These terms are governed by the laws of the Republic of Türkiye. Courts in Türkiye have jurisdiction, without removing any mandatory consumer protection or forum rights you have where you live. [Lawyer to confirm, including EU online dispute resolution wording if consumers are targeted.]
